Terms and Conditions of Dee’s Dogz

These terms and conditions apply between you, the User and dog owner/handler, and Dee’s Dogz, the owner and operator of the website.

This page defines the terms and conditions in which we enable you to make a booking for a place on any of our courses, classes, workshops, walks or trails, (forwardly listed as Events) listed on our e-newsletters, social media and on our Website. Please read these terms and conditions carefully before booking any of our Events. 

You should understand that by booking any of our Events, you agree to be bound by these terms and conditions.

Please understand that if you refuse to accept these terms and conditions, you will not be able to book any of our Events.

Price and Payment

The price of any of our Events will be as quoted on our Website and relevant booking correspondence. Prices listed are inclusive of VAT at the prevailing rate unless otherwise stated.

Prices are liable to change at any time, but changes will not affect bookings in respect of which we have already sent you a Booking Confirmation, except in cases of obvious error.

You may pay for your booking online through the integrated booking system. Payment can be made by credit card, debit card or through online bank transfer.

We regret that we cannot accept cheques as payment for bookings made.

Payment must be made at the point of booking in full. If payment is not made Dee’s Dogz reserves the right to refuse participation in the service you have signed up for.

Please note that we cannot guarantee the security of data which you send us by email. Accordingly, please do not send us payment information using email. Unless we are fraudulent or negligent, we will not be liable to you for any losses caused as a result of unauthorised access to the personal and transactional information that you provide us when making a booking.

Refund Policy

Booking is confirmed at the time of payment and payment is non-refundable outside the 14 day statutory cancellation period. If your booking is made within 14 days of the start of the Event then you agree to waiver your right to rely on the 14 day statutory cooling off and cancellation period.

If you become ill or your dog becomes ill, meaning you cannot attend the Event, you will need to provide a doctors or licensed veterinarian note stating such. You will then be signed up for the next possible course to make up for the one you could not attend. Alternatively, you can find a replacement. If you are able to find a replacement then you may receive a refund, minus booking transaction fees incurred, however this will be solely at Dee’s Dogz discretion and no guarantees are made for refunds.

Special Offers

We reserve the right, from time to time, to run special promotional offers on Events. Special Offers may include, but are not limited to, price promotions and discounts or competitions. In the event of a Special Offer, additional terms and conditions may apply which will be made available at the time of booking.

Any places booked at an Event prior to the Special Offer will not be offered the promotion retrospectively, unless specifically agreed by Dee’s Dogz.

Confirmation of Booking

After making a booking you will receive an e-mail from us acknowledging that we have received your booking request and confirming your place on the Event. Please note that if we do not receive payment at the time of booking then no confirmation will be sent. 

The contract between us will only be formed when we send you the Booking Confirmation. The Contract will relate only to those Events which we have confirmed in the Booking Confirmation. Should there be a limited number of places at each Event these will be allocated in order of receipt of bookings, on a first come first served basis.

Event Content

We reserve the right to make changes to the published programme of an Event (but not the overall content), for example to timings and/or trainers if one is unable to attend. In such cases, you will not be entitled to a refund if you cancel your place.

Event Venue

Our Events are held at various locations in and around Shrewsbury, Shropshire.

You are liable for any loss or damage which you may cause to the venue/premises and agree to adhere to all housekeeping rules, procedures and policies (including policies as to behaviour and conduct) that may be in place.

If you have a disability or medical condition that requires special arrangements to be made, please notify us of your requirements when making your booking.

Cancellation and Postponed Events

We reserve the right at any time and without prior warning in our absolute discretion, to cancel your booking where we need to do so due to circumstances outside of our control (including, but not limited to, situations where sufficient numbers have not booked for the Event or severe weather). We shall have no liability for losses or costs which you may incur due to such cancellation but we shall refund you’re booking payment (minus booking transaction fees) or offer you an alternative Event if one is available. You have the choice of accepting the refund or attending the alternative Event.

In the case of a change to Event dates, timings or venue, Dee’s Dogz will inform participants as soon as reasonably possible. If the trainer/instructor falls ill or cannot hold the Event for other reasons, Dee’s Dogz will postpone the event.

If the Event takes place with a smaller group, Dee’s Dogz reserves the right to shorten the time/length of the Event accordingly.

Dog Health

Only healthy and fully vaccinated (titre tested) dogs are allowed to participate in any Event offered by Dee’s Dogz. The participant insures that the dog is free of diseases and fully vaccinated. If a bitch comes or is in season, the Event organiser has to be informed. If a dog falls ill shortly before or during the Event, Dee’s Dogz and/or the trainer/organiser is to be informed immediately to discuss further action and prevent a possible disease from spreading. All dogs accepted are required to be de-wormed and de-flead regularly.

Managing Participating Dogs

Dogs should be on lead at all times, unless otherwise stated or the trainer gives consent that you can walk your dog off-lead in a given area. Please be courteous to other attendees. Some dogs may need space; a yellow bandanna will be given to dogs that need a little more space than others. Dogs must be worked in a harness and not from a collar; refusal to use a harness will result in voiding your participation.

Your dogs will need to be left in the car at certain points while attending Events. It is your responsibility to make sure that the car has enough air circulation/flow and water is provided for the dogs’ health and safety.

It is your responsibility to clean up after your dog when it toilets and when necessary take this away with you to dispose of yourself.

Our Liability

We cannot be held liable for any losses of any kind that arise from this contract or the provision of our services save for death or personal injury caused by negligence. This clause does not attempt to avoid any liability which cannot be excluded by law.

The participation in any Event offered by Dee’s Dogz is at your own risk which means the insurance lies with the participant/s themselves. We therefore make you aware, that you have to be insured to be able to participate in any Event. The participant is fully reliable for any damages/harm done by themselves, their dogs or the people that came with them.

Dee’sDogz and the organiser(s) and trainer(s), instructor(s) do not take ANY responsibility for ANY damage/harm done to a person(s) or a thing(s) (e.g. buildings, cars, dogs, personal belongings etc.). The participant takes the full responsibility for his/her dog(s), even if acting upon instruction of a trainer(s) or organiser(s).

You are fully responsible for your own and your dogs` actions. Dee’s Dogz cannot be asked to take over any costs for damage or harm done to you or your dog(s).

Dee’s Dogz does not take any responsibility in the case of injury or death of your dog(s), other animals or yourself or third parties.

Dee’s Dogz takes all reasonable precautions within the structure of our Events to avoid injury resulting from dog bites. However, Dee’s Dogz accepts no responsibility for damage or injury resulting from dog bites occurring to clients or their dogs while attending Events. The Control of Dogs Act 1986 section 21 – “Liability of owner for damage by Dog” applies within our classes/events/workshops/trainings/introduction courses and on our premises or public premises (rented from a third party or owned).

All instances of accident or injury must be reported to the dog trainer/instructor at the time they occurred.

Participants shall be required to keep their personal belongings with them at all times and we accept no liability for damage to, or loss of, personal belongings. We do not accept any responsibility for any loss or damage (including, without limitation, theft) of any personal property or belongings. 

We will not be responsible to you or any third party for any business loss (including loss of revenue, profits, contracts, anticipated savings, wasted expenditure, data or goodwill) or any other loss or damage which does not result directly from our actions.

Written Communications

When using our Website you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our Website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

Security

We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.

The information you share with us will only ever be shared when absolutely necessary such as in the case of an emergency to relevant medical or veterinary professionals.

Images and Publicity

Dee’s Dogz reserves the right to take pictures and videos during Events. Dee’s Dogz may use photographs taken at events in publicity and marketing materials, including use on our Website. Your attendance at an Event may mean that you are featured in such photographs/sound media and you are deemed not to object to the taking of such photographs as detailed above. If you do not wish to be included in any photograph/sound media, please notify the organiser/trainer/photographer at the relevant Event prior to the photographs being taken.

Copyright

All the copyright is reserved by Dee’sDogz. This includes material, videos, pictures, texts, etc. Information in any form, provided during an Event, in its original form or modified, can only be used/published with written consent from Dee’s Dogz. Voice recordings and videos of any Event have to be permitted by Dee’s Dogz.

Non-Competition Clause

Any individual participating in introduction courses, seminars, workshops or any other event offered by Dee’s Dogz or any guest training instructor agrees not to conduct/hold/offer such or similar, to the general public or another business or third parties within the United Kingdom within two consecutive years after the event. This includes ANY Mantrailing Event ONLY with written consent of the Mantrailing Head Instructor can this be changed. 

Our Right to Vary these Terms and Conditions

We have the right to revise and amend these terms and conditions from time to time to reflect changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system’s capabilities.

You will be subject to the policies and terms and conditions in force at the time that you place a booking with us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to bookings previously made by you), or if we notify you of the change to those policies or these terms and conditions before we send you the Booking Confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of the Booking Confirmation).

General

Events are generally held in all weathers. It is the participant’s responsibility to dress appropriately for the weather conditions; sturdy, comfortable footwear is essential.

The following items are NOT PERMITTED at any Event under any circumstances: Electric shock collars, including citronella; any other device that causes discomfort, pain or fear to the dog; Prong or pinch collars; Any equipment that the trainer deems unacceptable.

You should understand that by booking any of our Events, you agree to be bound by these terms and conditions.

Law and Jurisdiction

Contracts for the booking of our Events through our website/social media platform will be governed by the law of England and Wales. Any dispute arising from, or related to, such Contracts shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
